Nevada State Liens ("NSL") and the undersigned individual and/or entity ("lien claimant") are the parties to this agreement and are bound by the terms and conditions herein.
SCOPE OF SERVICE
For consideration received, NSL will process, mail, and file documents in connection with a lien order for a motor vehicle, motorcycle, RV, boat, trailer or OHV ("unit"). The lien shall be serviced and perfected in compliance with Nevada law. Services rendered are defined as the processing, mailing or filing of documents used in the normal course of business by NSL sufficient to receive a Nevada title. Service is deemed commenced on the date any action is taken in furtherance of processing the lien. Performance according to the terms of a selected lien service shall commence upon (i) execution of an online E-Application by the lien claimant or an authorized agent of the lien claimant; (ii) receipt of the repair order or contract that contains the signature of the debtor; and (iii) full payment for the selected lien service. Service is deemed complete when the debt owed to the lien claimant is satisfied or settled, or on the date of the auction sale, whichever occurs first.
NSL will warranty notices of correction from the State related to lien service conducted solely by NSL. Notices of correction must be within the scope of service detailed herein (i.e. processing, mailing or filing of documents used in the normal course of business). There shall be no warranty for a lien that cannot be perfected due to matters beyond the scope and/or control of NSL including, but not limited to invalidity of business license, bankruptcy, incorrect information submitted to NSL, court intervention, etc. Lien sale affidavits must be executed before a notary and received by NSL within 15 days of auction sale or lien claimant's warranty may be void. For the purpose of warranty, NSL shall determine in its sole discretion whether any matter is beyond the scope or control of service.
Compensation for all lien services shall be prepaid via Paypal, credit card or company check.
LIEN CLAIMANT'S DUTIES
1. Lien Claimant to fax or email a copy of the signed repair order or contract to NSL. (Lien cannot process until received).
2. Lien Claimant to provide NSL with the purchase price of the sold unit along with the complete name and address of the purchaser, if any.
3. Lien Claimant to collect applicable sales tax and fees from the purchaser.
4. Lien Claimant to immediately notify NSL of satisfaction of debt so that the lien may be vacated.
5. Lien Claimant to execute and return original notarized lien sale affidavit to NSL within 15 days of auction sale.
Except for the indemnity provision, the remainder of this contract will terminate automatically upon completion of the scope of service detailed herein.
All cancellation requests must be in writing and shall be emailed to firstname.lastname@example.org.
If a request for lien service is cancelled by the lien claimant after processing of the lien has begun, there shall be no refund. A refund will issue in instances where a title could not be perfected due to error by NSL. There shall be no refund for a lien that cannot be perfected due to matters beyond the scope and/or control of NSL including, but not limited to invalidity of business license, bankruptcy, court intervention, incorrect information, etc. Paypal transaction fees are non-refundable in all circumstances.
The Undersigned hereby declare that the statements made herein are true and correct, and are made to induce NSL to execute lien service on behalf of the lien claimant. In consideration of the execution, the undersigned in their individual and corporate capacity jointly and severally agree to indemnify NSL, and its principles against all loss, liability, costs, damages, attorney fees and expenses whatever, the indemnitee's own negligence, which NSL may sustain or incur by reason of executing the lien service, in making any investigation on account thereof, in prosecuting or defending any action which may be brought in connection therewith, in obtaining a release therefrom, in pursuing the right of indemnity, and in enforcing any of the agreements herein contained. NSL shall have the right and is hereby authorized to investigate, adjust, settle or compromise any claim, demand, suit or judgment upon NSL. In no event shall a notice to terminate service discharge the undersigned as to any damages sustained or incurred by NSL as a result of ordering, preparing, processing, drafting, mailing and/or filing lien documents. An itemized statement of fees shall be prima facie evidence of the fact and extent of the indemnitor's liability. That this Agreement shall be binding upon the Undersigned under the laws of the State of Nevada and shall be liberally construed against the Undersigned.
Due to the Federal Driver's Privacy Protection Act 18 U.S.C. Chapter 123 § 2724, et seq., all documents ordered, processed, drafted, mailed or filed in connection with lien service are the exclusive property of NSL and shall not be disclosed or released to the lien claimant or a third party unless authorized by statute or valid court order.
All lien services shall incur a title fee in addition to the base price of the service. Information regarding add-on fees may be found on the PRICING page. No lien will process where the signature of the debtor is absent from the repair order or contract. No lien will process where the Lien Claimant has failed to execute the online E-App, make full payment, and provide an executed work order. Units titled outside of Nevada take longer to process. Lien sale affidavits that are not executed and received by NSL within 15 days after the date of auction sale may void warranty. In such an event, a new fee may be incurred by the lien claimant related to an extension of time to file. If the commencement dates of Standard lien service fall on a weekend or holiday, the service will commence on the next business day.
